Official Rules: Modern Mountain Vacations Lake Trail Lodge Giveaway

1. Sponsor

This giveaway ("Giveaway") is sponsored by Modern Mountain Vacations, PO Box 11790, Zephyr Cove, NV 89448 ("Sponsor"). Questions may be sent to hello@modernmountainvacations.com.

2. Instagram Disclaimer

This Giveaway is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc. By entering, participants release Instagram and Meta Platforms, Inc. from any and all liability related to this Giveaway.

3. Eligibility

The Giveaway is open to legal residents of the fifty (50) United States and the District of Columbia who are at least twenty-five (25) years of age at the time of entry. The winner must present a valid government-issued photo ID to verify age and identity. Employees, officers, and directors of Sponsor, the owner of the prize property, and their respective parent companies, affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members (spouse, parents, children, siblings, and their respective spouses) and persons living in the same household are not eligible. The Giveaway is subject to all applicable federal, state, and local laws and regulations.

4. Entry Period

The Giveaway begins on October 12, 2026 at 12:00 AM Pacific Time and ends on December 14, 2026 at 11:59 PM Pacific Time ("Entry Period"). Sponsor's computer shall be the official timekeeping device.

5. How to Enter

To enter, during the Entry Period: (a) follow Sponsor's Instagram account (@modernmountainvacations); (b) like the designated Giveaway post; and (c) comment on the Giveaway post tagging at least one (1) friend. Entrants who complete all three steps receive one (1) entry. Limit one (1) entry per person, regardless of the number of comments or tags posted. Tagged accounts must belong to real people; tagged friends are not required to take any action and are not entered unless they complete the steps themselves. Sponsor may verify that the potential winner completed all steps and still follows Sponsor's account at the time of the drawing. No purchase, payment, or other consideration is required to enter or win. Entries that are incomplete, automated, generated by script, from fake or duplicate accounts, or otherwise not in compliance with these Official Rules may be disqualified at Sponsor's sole discretion.

6. Odds

Odds of winning depend on the number of eligible entries received.

7. Winner Selection and Notification

One (1) winner will be selected in a random drawing from all eligible entries on or about December 15, 2026. The potential winner will be notified via Instagram Direct Message from the official @modernmountainvacations account within forty-eight (48) hours of selection. Sponsor will never ask for payment or banking information to claim the prize. The potential winner must respond within seventy-two (72) hours of notification, or the prize may be forfeited and an alternate winner selected. As a condition of receiving the prize, the winner may be required to sign and return an Affidavit of Eligibility, Liability Release, and, where lawful, a Publicity Release.

8. Prize

The winner will receive one (1) complimentary two (2) night stay at Lake Trail Lodge, a vacation rental home in South Lake Tahoe, California. The prize covers the nightly rate only. The winner is responsible for all cleaning, service, and booking fees and any applicable lodging taxes, payable at the time of booking (fees are currently approximately $510, plus applicable taxes). Approximate Retail Value ("ARV"): $1,600. Actual value varies by dates selected; any difference between the ARV and actual value will not be awarded. The winner is solely responsible for all federal, state, and local taxes associated with receipt or use of the prize. Sponsor may issue an IRS Form 1099 if required by law.

9. Prize Conditions and Property Policies

The prize is subject to the following conditions:

  • The stay must take place between January 5, 2027 and May 14, 2027, with check-out no later than May 14, 2027.

  • Weekday stays only: both nights must be Sunday, Monday, Tuesday, Wednesday, or Thursday nights. Friday and Saturday nights are excluded. Minimum-stay requirements are waived for this prize.

  • Blackout dates: stays may not include the nights of February 14–18, 2027 (Presidents' Day week). Reservations are subject to availability.

  • The winner must be the primary guest, be twenty-five (25) years of age or older, and be present for the entire stay.

  • Maximum occupancy is eight (8) guests; up to five (5) children aged thirteen (13) and under do not count toward this total. A maximum of three (3) vehicles is permitted.

  • No pets are permitted, except legally required service animals in compliance with applicable law.

  • The winner must sign Sponsor's rental agreement and good neighbor contract and comply with City of South Lake Tahoe vacation rental rules, including quiet hours of 10:00 PM to 8:00 AM.

  • The winner must provide a valid credit card for incidental charges or damages.

  • Sponsor is not responsible for weather, road closures, chain controls, or ski area conditions. No extension, rescheduling, refund, or substitution will be provided if the winner cannot travel during the redemption window.

  • The winner is responsible for all expenses not expressly included, including transportation, meals, lift tickets, travel insurance, and incidental costs.

  • The prize is non-transferable, non-refundable, and may not be redeemed for cash, except at Sponsor's sole discretion. Unused nights are forfeited.

  • Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable.

10. Publicity Release

Except where prohibited by law, acceptance of the prize constitutes the winner's consent for Sponsor to use the winner's name, Instagram username, likeness, photograph, voice, opinions, and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

11. California Residents

By entering, entrants waive any rights under California Civil Code Section 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

12. Privacy

Information collected from entrants will be used solely to administer this Giveaway and in accordance with Sponsor's Privacy Policy. Sponsor will not sell or share personal information for marketing purposes without consent, consistent with applicable California privacy laws.

13. Limitation of Liability

To the fullest extent permitted by law, entrants agree to release and hold harmless Sponsor, the owner of the prize property, and their affiliates, officers, directors, employees, and agents from and against any claim or cause of action arising out of participation in the Giveaway or receipt, use, or misuse of any prize. Nothing in these Official Rules shall exclude or limit liability where such exclusion is prohibited under California law.

14. Dispute Resolution; Choice of Law; Venue

This Giveaway and these Official Rules shall be governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising out of or relating to this Giveaway shall be brought exclusively in the state or federal courts located in El Dorado County, California, and entrants consent to the personal jurisdiction of such courts. Except where prohibited, entrants agree that any and all disputes shall be resolved individually, without resort to any form of class action.

15. General Conditions

Sponsor reserves the right, in its sole discretion, to cancel, suspend, or modify the Giveaway if fraud, technical failures, or any other factor impairs its integrity or proper functioning. Sponsor is not responsible for lost, late, misdirected, incomplete, or undeliverable entries or communications. Sponsor's decisions are final. If any provision of these Official Rules is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
